オンラインショップご利用規約

本利用規約（以下「本規約」といいます。）は、TAHAHI PTY LTD（ABN 94 691 046 018、屋号：flemington vintage。以下「当社」といいます。） が運営するオンラインストア flemington vintage（以下「本ストア」といいます。）の利用条件を定めるものです。

本ストアをご利用いただくことにより、お客様は本規約および本ストアに掲載される各種ポリシーに同意したものとみなされます。

第1条　適用

本規約は、本ストアの閲覧、商品の購入その他本ストアの利用に関する、お客様と当社との間の関係に適用されます。

返品・返金、配送、プライバシーその他特定の事項について本ストアに別途ポリシーが掲載されている場合、当該ポリシーも本規約の一部を構成します。

本規約と個別ポリシーの内容が異なる場合は、当該事項についてより具体的に定めた個別ポリシーが優先します。ただし、適用される法令に別段の定めがある場合を除きます。

第2条　商品について

当社は、商品説明、写真、サイズ、素材、状態その他の商品情報について、合理的に確認可能な範囲で正確な情報を提供するよう努めています。

ヴィンテージ品は、その年代および性質上、使用、保管、修理、交換、経年変化等の履歴を有する場合があります。

商品の個別の状態、交換部品、非純正部品、傷、変色その他の特徴について商品ページに記載されている場合、それらは当該商品の状態の一部を構成します。

写真の色味や質感は、撮影環境、照明、モニターまたは端末の表示設定等により実物と多少異なって見える場合があります。

本条は、商品が説明と重大に異なる場合、重大な不具合がある場合その他、適用される消費者保護法に基づくお客様の権利を制限するものではありません。

第3条　注文および売買契約

お客様が注文を送信した時点では、商品の購入申込みが行われたものとします。

当社が注文を確認し、注文を受け付けた旨を通知した時点で、当社とお客様との間に売買契約が成立します。

以下のような合理的な理由がある場合、当社は注文を受け付けない、または成立後の注文を取り消す場合があります。

  • 決済が完了しない場合

  • 商品が販売済みまたは在庫切れであることが判明した場合

  • 商品価格または商品情報に明らかな誤りがあった場合

  • 不正利用または不正取引の疑いがある場合

  • 配送先へ合理的に配送できない場合

  • その他、法令上または運営上やむを得ない事情がある場合

注文を取り消す場合、当社は可能な限り速やかにお客様へご連絡し、すでに受領した商品代金について必要な返金を行います。

第4条　注文のキャンセル・返品・返金

注文のキャンセル、返品、交換および返金については、本ストアに掲載する 返品・返金・キャンセルポリシー（Refund Policy） が適用されます。

ヴィンテージおよび一点物という商品の性質上、お客様都合による返品・交換を原則としてお受けしていない場合があります。

ただし、Australian Consumer Lawその他、お客様の購入に適用される消費者保護法により認められる権利を排除または制限するものではありません。

第5条　価格および支払い

商品の販売価格は、注文時に本ストアまたはチェックアウト画面に表示される金額とします。

価格、プロモーションその他の販売条件は、予告なく変更される場合があります。ただし、すでに成立している注文については、法令上または明らかな表示誤り等の正当な理由がある場合を除き、注文成立時の条件が適用されます。

お客様は、正確かつ最新の請求・決済情報を提供するものとします。

第6条　配送

配送方法、送料、送料無料条件、お届け目安その他の配送条件については、本ストアに掲載する Shipping Policy が適用されます。

すべての配送予定日は目安であり、通関、配送会社の事情、天候、繁忙期その他当社の合理的な管理を超える事情により遅延する場合があります。

配送上の問題が発生した場合は、当社までご連絡ください。追跡情報の確認その他、合理的な範囲で対応いたします。

本条は、適用される消費者保護法に基づく配送または商品の受領に関するお客様の権利を制限するものではありません。

第7条　関税・輸入税

海外への配送について、関税、輸入税、通関手数料その他の公租公課が発生する場合があります。

適用される法令に別段の定めがある場合を除き、これらの費用はお客様のご負担となります。

第8条　アカウント

お客様が本ストアでアカウントを作成する場合、ログイン情報およびパスワードを適切に管理してください。

お客様は、ご自身のアカウントを第三者へ譲渡、販売または不正に利用させてはなりません。

不正利用が疑われる場合は、速やかに当社までご連絡ください。

第9条　禁止事項

お客様は、本ストアの利用にあたり、以下の行為を行ってはなりません。

  • 法令または公序良俗に違反する行為

  • 詐欺、不正決済その他の違法行為

  • 当社または第三者の知的財産権を侵害する行為

  • 本ストアの運営、サーバーまたはネットワークを妨害する行為

  • 不正アクセスまたはその試み

  • マルウェアその他有害なプログラムを送信する行為

  • 他人になりすます行為

  • 他者の個人情報を不正に収集する行為

  • 本ストアのコンテンツを無断で商業利用、複製または転載する行為

  • その他、当社が合理的に不適切と判断する行為

第10条　知的財産権

本ストアに掲載される文章、商品写真、動画、ロゴ、グラフィックその他のコンテンツに関する著作権、商標権その他の知的財産権は、TAHAHI PTY LTD、flemington vintage、各コンテンツ提供者またはその他の正当な権利者に帰属します。

権利者の許可なく、これらを複製、転載、改変、販売、商業利用その他の二次利用をすることはできません。

第11条　第三者サービスおよびShopify

本ストアは、Shopifyが提供するEコマースプラットフォームを利用しています。

ただし、お客様による本ストアでの商品購入に関する売買契約は、お客様とTAHAHI PTY LTD trading as flemington vintageとの間で成立するものであり、Shopifyは商品の販売者ではありません。

本ストアでは、決済、配送、分析その他の目的で第三者サービスを利用する場合があります。

第三者サービスには、それぞれの利用規約およびプライバシーポリシーが適用される場合があります。

第12条　個人情報

当社がお客様から取得する個人情報については、本ストアに掲載する Privacy Policy に従って取り扱います。

本ストアはShopifyを利用しているため、本ストアの提供に必要な範囲でShopifyおよび関連サービス提供者が個人情報を処理する場合があります。

第13条　サービスおよびウェブサイト

当社は、本ストアを安全かつ適切に運営するよう合理的な努力を行いますが、メンテナンス、システム障害、通信障害、第三者サービスの停止その他の事情により、一時的に本ストアの全部または一部を利用できない場合があります。

当社は、法令で認められる範囲において、本ストアの内容、機能または提供方法を変更することがあります。

第14条　責任の制限

本規約のいかなる規定も、Australian Consumer Lawその他適用される法令により排除、制限または変更することのできない権利または救済を排除、制限または変更するものではありません。

法令で認められる最大限の範囲において、当社は、当社が合理的に管理することのできない事情から生じる間接的または結果的な損害について責任を負わない場合があります。

ただし、本条は、当社の故意、重大な過失、法令違反その他法的に免責することのできない責任を免除するものではありません。

第15条　消費者の法的権利

Australian Consumer Lawに基づく消費者保証その他、適用される法令上排除することのできない権利は、本規約および当社が提供する任意の保証とは別に適用されます。

当社が独自の保証を提供する場合、その保証は法定の権利に追加して提供されるものであり、法定の権利に代わるものではありません。

海外のお客様についても、その購入に強制的に適用される消費者保護法上の権利がある場合、本規約はその権利を制限するものではありません。

第16条　本規約の変更

当社は、法令、サービス内容その他の事情の変更に応じて、本規約を変更する場合があります。

重要な変更については、適用される法令に従い必要な通知を行います。

変更後の規約は、特段の定めがない限り、掲載後の利用または取引について適用されます。

第17条　分離可能性

本規約の一部が法令により無効または執行不能と判断された場合でも、その他の規定の有効性には影響しません。

無効または執行不能な規定については、適用される法令で認められる最大限の範囲で適用されます。

第18条　準拠法

本規約は、適用される強行法規および消費者保護法上の権利を害しない範囲で、オーストラリア・クイーンズランド州の法律に準拠します。

本規約のいかなる内容も、お客様の居住地域その他の法域において強制的に適用される消費者保護法に基づく権利を制限するものではありません。

These Terms of Service (“Terms”) govern the use of the online store operated by TAHAHI PTY LTD (ABN 94 691 046 018), trading as flemington vintage (“we”, “us” or “our”).

By accessing, browsing or purchasing through our store, you agree to these Terms and the policies made available through our website.

1. Application of these Terms

These Terms apply to your access to and use of our website and to purchases made through our online store.

Our Refund Policy, Shipping Policy, Privacy Policy and other policies published on our website form part of these Terms where relevant.

2. Our Products

We take reasonable care to provide accurate product descriptions, photographs, measurements, materials, condition information and other details available to us.

Vintage items may, by their nature, show signs of previous use, storage, repair, replacement, servicing and natural ageing.

Where specific wear, replacement parts, non-original components, discolouration or other characteristics are disclosed in a product listing, those disclosed characteristics form part of the condition of the item being offered.

Colours and textures may appear slightly different depending on photography, lighting, screen settings and the device used.

Nothing in this section limits your rights where an item is materially different from its description, has a significant undisclosed fault or otherwise fails to meet consumer protection requirements applicable to your purchase.

3. Orders

Submitting an order constitutes an offer to purchase from us.

A contract of sale is formed when we confirm that we have accepted your order.

We may decline or cancel an order where there are reasonable grounds to do so, including where:

  • payment cannot be processed;

  • an item has already been sold or is unavailable;

  • there is an obvious error in pricing or product information;

  • fraud or unauthorised payment is reasonably suspected;

  • delivery to the nominated address is not reasonably possible; or

  • cancellation is otherwise required by law or circumstances reasonably outside our control.

If we cancel an order after receiving payment, we will provide any refund required as soon as reasonably practicable.

4. Cancellations, Returns and Refunds

Cancellations, returns, exchanges and refunds are governed by our Refund Policy published on this website.

Due to the vintage and one-of-a-kind nature of many of our products, we may not generally accept change-of-mind returns or exchanges.

However, nothing in these Terms or our Refund Policy excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other consumer protection laws applicable to your purchase.

5. Prices and Payment

The price payable for an item is the price displayed through our store or checkout at the time your order is placed.

Prices, promotions and offers may change without notice.

Changes will not normally affect orders that have already been accepted, except where there is an obvious pricing error, a legal requirement or another legitimate reason permitting a change or cancellation.

You are responsible for providing accurate and current billing and payment information.

6. Shipping and Delivery

Shipping methods, rates, free-shipping thresholds and estimated delivery times are set out in our Shipping Policy.

Delivery times are estimates and may be affected by customs processing, carriers, weather, peak periods or other circumstances reasonably outside our control.

If there is a problem with delivery, please contact us and we will assist with tracking and reasonable enquiries with the relevant carrier.

Nothing in this section limits any rights you may have under applicable consumer protection law.

7. Customs and Import Charges

International orders may be subject to customs duties, import taxes, clearance fees or other governmental charges.

Unless applicable law requires otherwise, these charges are the responsibility of the recipient.

If you create an account with our store, you are responsible for maintaining the security of your account credentials.

Text, product photographs, videos, logos, graphics and other content made available through our store are owned by TAHAHI PTY LTD, flemington vintage, our licensors, content providers or other lawful rights holders, as applicable.

You may not reproduce, distribute, modify, republish or commercially use this content without permission from the relevant rights holder.

11. Shopify and Third-Party Services

Our store is hosted using Shopify's ecommerce platform.

However, purchases made through our store are transactions directly between you and TAHAHI PTY LTD trading as flemington vintage. Shopify is not the seller of the products offered by us.

We may also use third-party payment, shipping, analytics or other service providers. Your use of those services may also be subject to their applicable terms and privacy policies.

12. Privacy

Personal information collected through our store is handled in accordance with our Privacy Policy, which is available on this website.

Because our store is hosted by Shopify, Shopify and other service providers may process personal information where necessary to provide and operate the Services.

13. Availability of the Services

We take reasonable steps to maintain the availability and security of our online store.

However, the website or parts of it may occasionally be unavailable due to maintenance, technical failure, communications issues, third-party services or circumstances outside our reasonable control.

We may modify the content, functionality or operation of the store where reasonably necessary and permitted by law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

Consumer guarantees and other rights that cannot be excluded under the Australian Consumer Law apply independently of these Terms and any voluntary warranty we may offer.

Any voluntary warranty provided by us is additional to, and does not replace or restrict, statutory consumer rights.

Where mandatory consumer protection laws in another jurisdiction apply to your purchase, nothing in these Terms is intended to exclude or restrict those mandatory rights.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes in law, our Services or our business operations.

Where required by applicable law, we will provide notice of material changes.

Unless otherwise stated, revised Terms will apply prospectively after they are published.

17. Severability

If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be applied to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

18. Governing Law

Subject to mandatory consumer protection laws that may apply to you, these Terms are governed by the laws of Queensland, Australia.

Nothing in these Terms prevents you from relying on mandatory consumer protection rights that apply in your jurisdiction.
